Terms of Use

01. Acceptance of Terms

EYBIS provides its services to you subject to the following Terms of Service (“TOS”), which may be updated by EYBIS from time to time without prior notice. You can review the most current version of these Terms at any time at https://www.eybis.com/termsEN.html.
By accessing or using the EYBIS website or registering for any EYBIS event, you agree to be bound by these Terms.

02. Description of Service

EYBIS organises motorcycle track events – mainly on GP circuits – across Europe. The EYBIS.com website provides information about these events and allows participants to register and enrol for them (the “Service”).

You understand and agree that the Service may include advertisements that are necessary for EYBIS to provide it, and that certain communications from EYBIS (including service announcements, administrative messages, and the EYBIS Newsletter) are part of your EYBIS membership and cannot be opted out of.

Unless otherwise stated, any new features that enhance or extend the current Service are subject to these TOS.
You acknowledge that the Service is provided “AS IS” and that EYBIS assumes no responsibility for any delay, deletion, misdelivery, or failure to store any user data or communications.

Transponders for Timekeeping (PowerTrophy)
When you receive a transponder, you are fully responsible for it. The transponder must be correctly attached to your motorcycle. In case of loss or damage, a fee of 600 € will be charged to the rider, payable immediately. By registering for the event, you expressly agree to these conditions.

03. Registration Obligations

You agree to:

    • Provide true, accurate, current, and complete information about yourself as requested in the registration form (“Registration Data”);
    • Maintain and promptly update this information to ensure its accuracy and completeness;

If EYBIS reasonably suspects that the information you have provided is false, inaccurate, outdated, or incomplete, EYBIS reserves the right to suspend or terminate your account and refuse any and all current or future use of the Service.

04. Privacy Policy

Your Registration Data and other personal information are subject to our Privacy Policy.
By using the Service, you consent to the collection and use of your information in accordance with that policy.

05. Member Account, Password, Security

During registration, you may create a username and password. You are solely responsible for maintaining their confidentiality and for all activities that occur under your account. You agree to immediately notify EYBIS of any unauthorised use of your account or any other security breach. EYBIS cannot and will not be held liable for any loss or damage resulting from your failure to comply with this section.

06. Cancellation of an Event

By you as a customer

Cancellation insurance

Ideally, you have your own cancellation insurance.
If you don't have one, you can cancel with us according to the modalities as described below, and - more in details - as described on the EYBIS.com website under "Practical Info / Cancellation of an Event".

Is possible

Cancelling an event is always possible in "normal circumstances" (see below for its definition).

Miscellaneaous

If you have booked a multi-day event and wish to cancel part of it (e.g. one day), we will need to cancel your entire booking.
From an administrative and technical point of view, each combination of bookable days on a circuit is treated as a separate event.
So, for example, we cannot simply remove one day from a three-day booking.
However, we can cancel your original three-day booking, after which you can rebook for a different combination of dates (e.g. one or two days).

By an organisation

Other organisations or entities that purchase one or more spots as part of a contingent – for which we handle the reservation and manual invoicing – cannot cancel or return these spots. Cancellation is therefore not possible in such cases.

By EYBIS due to force majeure

Definition and examples

“Force majeure” shall mean any circumstance rendering the execution of the event impossible, dangerous and/or unreasonable, beyond the control of EYBIS. This includes, but is not limited to: cancellation of the event by the circuit; governmental prohibitions preventing the organisation of events or making it unreasonably difficult; natural disasters such as earthquakes, tidal waves or floods; terrorist attacks, war, insurrection, riots, strikes or closure of borders; epidemics or pandemics. Once such a situation arises, the aforementioned “normal circumstances” no longer apply.

Obligation of best efforts in case of imminent force majeure

In the event of force majeure (or the anticipation thereof), EYBIS shall first make every reasonable effort to ascertain whether the event can still take place. Only once it has been definitively and irreversibly established that the event cannot proceed, and after all reasonable alternatives have been examined and attempted, will EYBIS inform the participants that the event will not take place.

Consequences for the participant

If an event is cancelled due to force majeure, EYBIS – within reasonable limits – shall offer the participant the choice between the following options, regardless of whether cancellation insurance has been taken out:

  1. Postponement of the event: provided that the circuit can offer a new date acceptable to EYBIS within the same calendar year. Participants will be informed of this new date as soon as possible by e-mail.
  2. Vouchers: conversion of 100% of the amount already paid into vouchers. No additional costs for the participant. Valid for two years from the date of issue. Not personal: freely transferable and usable by third parties. For multi-day events, one voucher will be issued per booked day. The registration system accepts only one voucher per registration.
  3. Refund: EYBIS undertakes to refund 65% of the registration fee, provided that the relevant circuit has refunded EYBIS. In case of partial reimbursement by the circuit, a pro rata refund will be made to the participant. This always constitutes a monetary refund to the bank account, not credit in the form of vouchers. By choosing this option, no further claims can be made regarding the remaining 35%. This 65/35 ratio is based on the price composition of an entry ticket: 65% direct costs (circuit, travel, insurance, on-site operational expenses) and 35% indirect costs (organisation, preparation, administration, communication, logistics, rental, insurance, taxes, accounting, graphic and promotional expenses, etc.).

Double Event

In the event that a double event (a single booking combining two circuits) can only take place partially and one of the two circuits is cancelled, the participant may cancel their participation at the other circuit solely in accordance with the standard cancellation terms as set out under “By you as the customer” (see above). This provision likewise applies to any club, group of friends, or other organisation that has purchased a package of entries.

Exclusion of additional compensation

In the event of cancellation due to force majeure, EYBIS shall under no circumstances be obliged to reimburse any additional costs incurred by the participant(s), including – but not limited to – airline tickets, hotel accommodation, rental vehicles, motorcycle transport and similar expenses.

Other organisations

Other organisations that have purchased a contingent of places for an event that was cancelled due to force majeure are subject to the same rules and conditions as individual participants.

07. Motorcycle Transport

If you make use of the optional motorcycle transport service (when offered), EYBIS shall under no circumstances be held responsible for any damage to your motorcycle or material. You are solely and personally responsible for properly crating, securing, and protecting your motorcycle and any related equipment.

08. Indemnification

You agree to indemnify, defend, and hold harmless EYBIS, its subsidiaries, affiliates, officers, agents, partners, and employees from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Service;
  • Any content you submit, post, transmit, or make available through the Service;
  • Your violation of these TOS;
  • Your violation of any rights of another person or entity.

09. No Resale of Service

You agree not to reproduce, duplicate, copy, sell, trade, resell, or exploit for any commercial purposes any portion of the Service, its use, or access to it, without express prior written consent from EYBIS.

10. Links to Third-Party Sites

The Service may contain links to third-party websites or resources. Because EYBIS has no control over such sites or resources, you acknowledge and agree that EYBIS is not responsible for their availability or content, and does not endorse or assume any responsibility for any products, services, or materials available from such sites.

You further agree that EYBIS shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by your use of or reliance on any third-party content or services.

11. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
EYBIS expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
EYBIS makes no warranty that (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; or (c) the results obtained from the Service will be accurate or reliable.

12. Limitation of Liability

To the fullest extent permitted by law, EYBIS shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including but not limited to loss of profits, goodwill, data, or other intangible losses) arising out of or in connection with your use or inability to use the Service, even if EYBIS has been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, EYBIS’s liability shall be limited to the maximum extent permitted by law.

13. Intellectual Property Rights

You acknowledge that the Service, including any necessary software or content used in connection with it, contains proprietary and confidential information protected by applicable intellectual property laws.
Except as expressly authorised by EYBIS, you agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Service or its software, in whole or in part.
You further agree not to use modified versions of the software or access the Service through any means other than the interface provided by EYBIS.

14. Notices

EYBIS may communicate with you by e-mail, through postings on the website, or by other reasonable means such as Whatsapp a.o. Such notices shall constitute official communications.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Belgium.
Any dispute arising under or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Bruges, Belgium.
